The Process of Mutual Divorce / Talaq E Mubarat
The Muslim Family Laws Ordinance, 1961, outlines a specific procedure for divorces, including those by mutual consent. Here is an overview of the steps involved:
Mutual Agreement:
Both parties must agree to the divorce and settle key issues like the payment of dower (Mahr), maintenance, and the custody of any minor children.Notice of Divorce (Talaq):
After the agreement is reached, the husband must issue a written Notice of Divorce (Talaq) to the Chairman of the Union Council or Arbitration Council, as required under Section 7 of the Ordinance.Reconciliation Period
Upon receiving the notice, the Chairman will attempt to reconcile the parties. If reconciliation efforts fail, the divorce becomes effective after a period of 90 days.Completion of Iddat
After the divorce is finalized, the wife must observe the Iddat period, during which she cannot remarry. After the Iddat period is complete, the divorce is final, and both parties are free to move forward with their lives.
