What Talaq-e-Mubarat means
Mubarat is a form of dissolution based on the mutual desire of the spouses to end the marriage. A written agreement is useful because it creates a clear record of that decision and of the terms accepted by each party.
The document should identify the marriage accurately, state the parties’ consent without ambiguity and distinguish the dissolution itself from the financial, property and children-related arrangements recorded alongside it.
Legal procedure after the agreement
Section 8 of the Muslim Family Laws Ordinance, 1961 provides that, where a party wishes to dissolve a marriage otherwise than by talaq, section 7 applies with the necessary changes and so far as applicable. Section 7 addresses written notice to the Chairman, a copy to the other spouse, constitution of an Arbitration Council for reconciliation and the statutory period before effectiveness.
The correct notice, Union Council and supporting documents can depend on the facts and local administrative practice. Confirm the procedure instead of relying on the signed specimen alone.
Dower, maintenance and property terms
Write every financial term precisely. If dower is paid, unpaid, returned, remitted or adjusted, the agreement should state the amount and treatment clearly. Identify any maintenance, payment, jewellery, dowry articles, personal belongings or property that will be delivered, retained or released.
Avoid broad waivers that the parties do not understand. Where performance will occur later, include the amount or item, due date, delivery method and proof of completion.
Children, custody and maintenance
A mutual divorce agreement can record the parents’ present understanding about residence, contact, education and financial support. Those provisions should be drafted separately and with the child’s welfare in view.
Do not assume that an adult’s general waiver conclusively removes a child’s rights or prevents a competent court from considering custody or maintenance later. Obtain individual advice where children are involved.
Signing and supporting records
Check names and identity numbers against CNICs and marriage particulars against the Nikahnama. Each spouse should read the complete document before signing, and any witness or attestation arrangement should be appropriate for the intended use. Keep signed copies and proof of any payment or delivery made under the settlement.
If either spouse is abroad, cannot attend personally, disputes a term or acts through a representative, obtain advice before signing or submitting documents.
