Domestic service of court papers and legal notices in Pakistan
For documents issued in Pakistan, the court order and applicable procedural rules determine who is responsible for service and which methods are valid. Order V of the Code of Civil Procedure addresses the issue and service of civil summons, but other courts, tribunals and special laws may use different procedures. A party should not replace formal court service with private delivery unless the court or applicable rules permit it.
Private coordination can still be useful for legal notices, demands and other documents, or where a court or lawyer has authorised a party-arranged attempt. The instruction should identify the document, recipient, lawful method, deadline and exact proof required.
International process service and the Hague Service Convention
Pakistan is a contracting party to the 1965 Hague Service Convention for service abroad of judicial and extrajudicial documents in civil or commercial matters. A Convention request may involve a designated transmitting authority, Pakistan’s Central Authority, prescribed request and certificate forms, translation or duplicate-document requirements and the declarations made by Pakistan.
The sender should confirm the correct Convention route with the issuing court or foreign lawyer before instructing a private attempt. A private delivery can be additional evidence where lawfully permitted, but it should not be presented as a substitute for a required Central Authority or court-directed procedure.
What information should a process-service instruction contain?
A useful instruction identifies the issuing court or sender, country and jurisdiction, case title and number, document names, service deadline, permitted method and proof required. It should also provide the recipient’s full legal name, role or relationship to the case, complete address, alternative address and reliable identifying details.
Include every document and enclosure that must be served, the required number of sets and any translation. If service on a company is requested, specify the legal entity name, registered or operating address and the officer or category of person authorised to accept service under the applicable instructions.
What a service or non-service report should record
The report should identify the documents received, recipient, supplied address and each attempt by date and time. It should state who was encountered, what was said or done, whether documents were accepted or refused and any objective reason the address could not be completed. It should avoid assumptions about identity, residence or deliberate evasion unless supported by facts.
Depending on the agreed scope and local law, supporting material may include a signed acknowledgment, courier or delivery receipt, photographs of a location, location notes or a declaration or affidavit by the person who attempted service. The issuing forum decides what evidence is acceptable.
When the recipient cannot be found or refuses the documents
An unsuccessful attempt is not a licence to leave confidential papers with any available person. The process server should follow the authorised method, record the factual outcome and stop where the address, identity, safety or legal authority is uncertain. Further attempts may be scheduled at different reasonable times if they remain within the agreed instructions.
If the address is incorrect, the recipient has moved, access is restricted or service is refused, the sender may need a non-service report and directions from the issuing lawyer or court. Substituted service, service on another person, affixation, publication or electronic service should not be improvised without legal authority.
