What is a rent agreement in Pakistan?
A rent agreement records the landlord, tenant, premises, permitted use, tenancy dates, rent and the parties’ practical obligations. It is particularly valuable when there is a dispute about payments, the security deposit, repairs or possession.
The law that governs the agreement depends on where the property is located. A specimen can help identify useful clauses, but one provincial form should not be described as automatically suitable for every part of Pakistan.
Which law applies in Rawalpindi and Islamabad?
For covered rented premises in Rawalpindi and elsewhere in Punjab, check the Punjab Rented Premises Act, 2009. For premises within the notified urban areas of Islamabad Capital Territory, check the Islamabad Rent Restriction Ordinance, 2001, including its later amendments.
The parties should verify the property address and any special status before choosing the governing rules. Other provinces have their own laws. This general specimen deliberately leaves the applicable law and forum to be completed for the actual property.
What details should the agreement contain?
Record the full identity and address of both parties, a precise description of the property, the tenancy term, residential or commercial use, monthly rent, payment method and date, advance rent, security deposit and agreed treatment of utilities. Attach a signed inventory and meter readings.
A separate handover record helps establish the condition of the property and the keys delivered. Where an agent signs for an owner, check the authority to let the premises and receive rent.
How do the signing and filing requirements differ?
Under sections 5 and 6 of the Punjab Rented Premises Act, 2009, a tenancy is based on a written agreement and the Act specifies particulars to include. The agreement is presented to the Rent Registrar for entry as the Act provides. Check the current procedure, fees, stamp requirements and available office for the property.
Section 5 of the Islamabad Rent Restriction Ordinance, 2001, as amended in 2021, requires a written tenancy agreement and presentation before the Controller within thirty days of signing. The provision also states that the Controller entry does not remove any separate duty under the law relating to registration of documents. Confirm the current process before execution.
Rent, increases and proof of payment
State the rent amount, date due, bank or other permitted payment method, any agreed change and who pays which utility or maintenance charge. Keep crossed cheques, bank records or proper receipts as applicable.
Do not copy a fixed percentage or automatic increase into a nationwide form. The applicable rent statute can control increases. Islamabad has a specific provision on annual changes and written agreement, and Punjab has its own framework. Review the governing law when setting this clause.
Security deposit and property condition
Distinguish a refundable security deposit from advance rent and issue a receipt for each. State the deposit amount, what may legitimately be deducted, the evidence required for deductions and the process for accounting and refund after handover.
Photograph the property, list existing damage, record fixtures and keys and note opening utility meter readings. These simple records make a later disagreement about damage or unpaid bills easier to assess.
Repairs, utilities and access
Specify who handles routine maintenance, structural repairs, utility bills and reporting defects. Avoid vague clauses that assign every repair to one party regardless of the law or cause. Agree a practical process for giving notice and arranging access for inspection or repairs.
The applicable statute may protect access to essential amenities and set remedies when repairs are not made. The specimen therefore does not give either party a right to cut off services or forcibly remove an occupant.
Expiry, termination and eviction
State the tenancy dates and the intended renewal process. A contract can explain how parties communicate about expiry, breach or voluntary surrender, but mandatory grounds and procedures under the governing rent law still matter.
A landlord should not assume that the agreement alone permits an immediate lockout or removal of belongings. Likewise, a tenant should not assume that leaving without a documented handover resolves rent, deposit and utilities. Keep notices and written acknowledgement of possession return.
Stamp paper, registration and police reporting
Stamp duty, document registration, presentation before the Rent Registrar or Controller and local tenant reporting are distinct steps. Requirements depend on the property, the agreement term and the applicable provincial or ICT procedure. Paying for stamp paper does not by itself complete every other required step.
Before signing, confirm the current stamp value, any registration duty, the relevant rent office and any police tenant registration process with the appropriate authority. Keep the stamped or entered original and evidence of filing.

Is a written rent agreement required in Punjab?+

Does the same law apply to Rawalpindi and Islamabad?+

Does Islamabad require presentation of the agreement?+

Is signing on stamp paper enough?+

What is the difference between advance rent and security?+
Advance rent is allocated to an agreed rental period. A security deposit is generally held against documented obligations and should have its own receipt and clear refund or deduction terms.
Can the landlord raise rent whenever desired?+
An agreed clause must be checked against the law applicable to the premises. Rent increase rules differ by jurisdiction; avoid assuming that a generic clause overrides a statute.
Can a landlord evict a tenant when the agreement expires?+
Expiry may be relevant, but the applicable rent law and required forum and procedure must be followed. A specimen agreement is not an eviction order.
Can this template be used for a commercial shop?+
